Future directions in data breach disputes - 22 November 2023

We were delighted to host the online version of our popular in-person seminar on the future directions in data breach disputes, held earlier this year.

In the wake of the Optus and Medibank data breaches, each of those businesses faces a representative complaint and at least one class action. Until now, complaints and litigation arising from data breaches have been fairly rare in Australia. Will these actions mark a turning point in the frequency of data breach disputes in Australia?

This webinar looked at the various bases on which plaintiffs and complainants can bring actions in relation to a data breach under Australian law – through the OAIC complaints process, the tort of negligence, breach of contract, Australian Consumer Law, and shareholder actions – and the issues that arise with each. It also looked at the statutory tort of serious invasion of privacy and the proposed direct right of action under the Privacy Act.

Suzanne Liversidge, Global Managing Partner at Kennedys, was joined by Jenny Radcliffe, aka 'The People Hacker', a world-renowned Social Engineer, hired to bypass security systems through a no-tech mixture of psychology, con-artistry, cunning and guile. She can diffuse a crisis situation, talk her way into a secure building, and spot a psychopath at a hundred paces. She has been called a mind reader and a “human lie detector,” and likened to a Jedi Knight. In reality, she is an expert in social engineering (the human element of security), negotiation, persuasion and influence, and non-verbal communication and deception—using her skills to help clients ranging from global corporations and law enforcement organisations to poker players, politicians and the security industry.

Why including women is the missing key to innovation - 9 March 2022

As part of our global women in business series, and to celebrate International Women's day, we are delighted to have hosted a hybrid seminar with guest speaker Katrine Marçal.

In this talk, Katrine guided us through fascinating examples of how innovators have failed to take women's experiences into account, analysing what they can tell us about gender and innovation today. She examined current realms where our ideas about gender are holding innovation back in similar ways making the argument that the future will be shaped by companies that dare to think differently about gender.
