Blaise Chow is a partner in the New York office. He concentrates his practice in commercial litigation and professional liability, including advising on policies issued to directors and officers, financial institutions, and nonprofits. He has also advised clients on the complex range of insurance issues arising from securities litigation, cyber risk, intellectual property, and employment-related claims against both public and private entities. Blaise also defends directors and officers in cases alleging breach of contract, breach of fiduciary duty, and civil fraud.

In addition, Blaise counsels both individuals and companies in intellectual property needs, as well as employment issues such as equity, non-solicitation, non-compete, and confidentiality provisions. He has also been sought to help resolve disputed terminations, fee disputes, and severance agreements.

He listens to his clients’ needs and responds to their objectives on a case-by-case basis, presenting strategic options that allow his clients to make the best and most informed decision. When it’s clear that litigation is the best course of action, Blaise takes a business-oriented approach and uses litigation as a tool to protect clients and minimize costs, liability, and future risk.

Before joining Kennedys, Blaise counseled domestic and foreign clients on a wide variety of environmental matters pertaining to treaty and facultative reinsurance surrounding environmental matters and D&O products.

Blaise is a member of the board of directors of Apex for Youth, a nonprofit that provides mentoring opportunities to underserved immigrant youth. He formerly served on the board of a large non-profit running group, the Dashing Whippets Running Team, an organization that promotes diversity and health through running.

Blaise is also fluent in conversational Cantonese.

Work highlights

  • Successfully counseled a client on a cybersecurity breach in which the company’s email accounts were hacked. Our client was deceived into wiring funds to a fraudulent bank account after the hacker pretended to be the CEO and gave instructions to transfer the funds. We provided policy review and general advice to help the client resolve this matter.
  • Secured a nuisance value settlement of a putative class action on behalf of a national hospitality group in which the class was seeking more than $5 million. Succeeded in having the federal case remanded to state court after demonstrating that the amount in controversy did not meet the monetary threshold and, once in state court, was successful in dismissing a nationwide class in favor of a single state putative class.
  • Presently representing an insurance carrier in a D&O coverage dispute concerning the relatedness of claims involving the pharmaceutical industry’s purported fixing of generic drug prices.
  • Successfully negotiated insurance coverage issues arising out of a securities class action claim, including whether a certain entity was insured, whether the individual defendants needed to contribute personally towards the settlement, and whether the insured entity had non-insured exposure, helping the client reduce the amount of exposure during settlement.
  • Secured dismissal on behalf of a law firm that was sued as a result of a successful foreclosure prosecution. The plaintiffs sought leave to vacate the underlying foreclosure judgment, claiming they had discovered new evidence. The court agreed with our motion to dismiss, and the plaintiffs did not seek appeal.
