Tim is a legal director in Kennedys’ Glasgow office, and has expertise in employers’ liability, public liability, legacy disease claims, motor, property,  product liability (non-pharma), and defence and coverage, with a specialist focus on low value process, pre-action applications, fast track, multi-track DA and multi-track large loss.

Tim has extensive experience representing insurers in all aspects of personal injury and property damage claims. He regularly appears at procedural and substantive hearings in Scotland’s Sheriff Courts including the specialist All Scotland Personal Injury Court in Edinburgh.

He regularly provides advice to clients on the matters of Scottish costs both in terms of pre and post litigation position. He has appeared at a number of court hearings challenging the sanction of Counsel and scale of costs to be awarded.

Tim particularly specialises in multi-track claims for personal injury and property damage, dealing with all aspects of matters (litigation, investigations, costs etc.) from cradle to grave.

He also holds a number of other qualifications and positions, including Notary Public, FOIL Scottish Regional and Expenses Sector Focus Team Committee representative.

Work highlights

  • Utilising social media investigation techniques to force claimants to abandon two linked travel sickness claims shortly prior to trial with costs recovered for the defender.
  • Advanced a technical defence on the basis of jurisdiction and timebar resulting in the claimant abandoning a £75,000 claim in respect of fire damage. Full value of the claim well in excess of £100,000 including claimant costs.
  • Advising on a claim where the claimant sustained a permanent injury to his shoulder. Damages of £1.6 million were claimed with complex future loss arguments relying upon the Ogden tables. Matters settled at £175,000 following extensive negotiations.
