Shashi Silva is a Special Counsel in Kennedys' Sydney office. She has been representing clients in insurance claims for over 10 years.

The focus of Shashi’s practice is in professional indemnity matters for professionals in the health, allied health, construction, engineering and financial sectors. She also has extensive experience in defending public liability claims including for personal injury and property damage. She acts on behalf of national and international insurers and underwriters.

She has a particular expertise in health law, and regularly acts for registered health practitioners (including doctors, dentists and psychiatrists), leading private and public hospitals, allied health and other medical service providers.

Shashi has experience appearing in State and Federal courts in multiple Australian jurisdictions. She also appears before State health complaints commissions and AHPRA, and has extensive coronial experience in NSW and Victoria.

Shashi has a deep knowledge of insurer practices and processes. She completed a client secondment at a major Australian professional indemnity insurer managing a broad range of claims against professionals and coverage issues. She has also worked at a global insurer managing a portfolio of liability claims.

  • Acting for an IVF clinic in highly publicised claims for nervous shock and the costs associated with rearing and maintaining children, who suffered from a genetic condition known as Fragile X syndrome.
  • Acting for an aged care home in multiple high profile nervous shock and compensation to relative claims involving the murder of residents at the facility by an employed staff member.
  • Acting for general practitioners in matters involving the failure to diagnose breast cancer, and failure to diagnose multiple sclerosis in a timely manner.
  • Acting in complaints made to AHPRA and State health complaints commissions against psychiatrists and psychologists regarding the failure to maintain professional boundaries and obtain informed consent.
