Kennedys Legal Solutions advising the world’s largest port infrastructure project in Singapore
We are delighted to announce in Singapore that Kennedys Legal Solutions, via Partner Glenn G. Cheng, has secured expanded instructions to act for the head JV Contractor Daelim-DEME/Dredging International Asia Pacific JV on the Tuas Terminal Phase One ("TTP-1"), Finger 2 Project, as well as the head JV Contractor, Penta Ocean-Hyundai-Boskalis JV on the Tuas Terminal Phase Two ("TTP-2"), Finger 3 Project.
TTP-1 and TTP-2 packages are concerned with the marine and civil engineering aspects of the Project, and they total USD 2.88 billion in combined base designed value. The legal briefs call for the various provision of advice and claims (and disputes) representations, as well as the provision of day-to-day project support on claims, compensable variation and other forms of contractual relief, value engineering and other controls and remedies in respect of Turnkey / EPC contract packages for seabed dredging (and fairway / shipping lane deepening), sand and fill supply, reclamation works, including bunding, foreshore defences; as well as the construction of finger piers / caisson quays, wharves, ancillary structures and (onshore) primary infrastructure works.
The Tuas Terminal project is Singapore's ambitious move to consolidate the container terminals to the west of the island and double the current container handling capacity to 65 million TEUs when all (four) phases are completed in the 2040s, at an overall announced cost of over USD 14 billion.
Tuas Terminal is acknowledged as an engineering feat with many innovative features that will provide increased productivity, optimise land use, improve safety and security, and enhance sustainability. Completion of TTP-1 of this large-scale project had reportedly been challenging due to the disruptions caused by the COVID-19 global pandemic, notwithstanding that work started over six years ago, involving more than 450 companies and 34 million hours of work. Glenn has been involved in advising on TTP-1 since its launch in 2015 and continues today at the helm of providing legal advisory services to the head Contractor on this package. His role has now expanded to include TTP-2 in a similar capacity which, all things being constant, will last until the closing of 2027/8.
