Imogen Lowe is a legal director in Kennedys’ London office who specialises in advising insurers and reinsurers on complex claims across marine, yachts, aviation, war, political risks and political violence.

Her marine work includes hull & machinery, war, mortgagee’s interest, loss of hire, general liability, and protection & indemnity (P&I) matters. She handles all types of coverage and disputes work, and has acted in litigation at all levels up to the Supreme Court, as well as in arbitration and mediation.

Imogen is also very experienced in multi-jurisdictional matters, including complex jurisdiction disputes, and has acted on claims involving proceedings in jurisdictions including Syria, Venezuela, Italy, the US, the Philippines, the Netherlands, and Germany.

Work highlights

  • Acting for war risks insurers defending claims by aircraft lessors relating to the failure by Russian airlines to return aircraft following Russia’s invasion of Ukraine. This is one of the largest set of claims in the English courts, valued at many billions of dollars.
  • Acting for various war risks and mortgagee’s interest insurers in relation to vessels affected by Russia’s invasion of Ukraine.
  • Representing hull insurers in proceedings arising from the total loss of the vessel Kapitan Veselkov, including successfully resisting a challenge to the English court’s jurisdiction (Generali Italia S.p.A v Pelagic Fisheries Corp. [2020] EWHC 1228 (Comm))
  • Acting for the Club in claims following the sinking of a Venezuelan coastguard vessel, involving questions of jurisdiction, state immunity and anti-suit injunctions (Court of Appeal: UK P&I Club & Anor v Republica Bolivariana de Venezuela [2023] EWCA Civ 1497)
  • Acting for Atlantik Confidence hull insurers up to the UK Supreme Court and through Dutch proceedings seeking recovery of a claim paid where the loss was later found to have been fraudulent (Aspen Underwriting Ltd and others (Respondents) v Credit Europe Bank NV [2020] UKSC 11)
  • Successfully resisting English jurisdiction in the Court of Appeal for claims brought for business interruption losses in the Middle East arising from the Covid-19 period (Al Mana Lifestyle Trading LLC & Ors v United Fidelity Insurance Company PSC & Ors [2023] EWCA Civ 61).
  • Advising mortgagee’s interest insurers on claims arising out of the alleged detention of vessels in Venezuela, involving English and German subrogation proceedings
  • Advising political violence insurers on claims arising from physical damage to premises following unrest in Syria
