Brian is a Senior Associate in Kennedys Commercial Disputes and Regulatory Team in Hong Kong.

Qualified in Hong Kong, he specialises in commercial dispute resolution and financial services regulatory investigations. In his practice, he has experience in handling commercial litigation, arbitration, regulatory investigation, and restructuring & insolvency matters. Brian has acted for international and Hong Kong-based companies, liquidators, regulated persons and high-net worth individuals.

Brian has previously spent time in the Discipline Department of the Accounting and Financial Reporting Council.

  • Acting for clients (insurers, professionals, high net worth individual, manufacturers, suppliers, employers, contractors, etc.) in handling a wide range of commercial litigation, including contractual disputes, debt recovery actions, mis-selling claims, shareholders disputes.
  • Acting for clients in arbitration, including commercial, construction, and sports disputes. Have acted in urgent construction disputes and sports arbitration at the Court of Arbitration for Sport.    
  • Advising and representing life insurers, regulated persons in contentious regulatory matters including inquiries / investigations / disciplinary proceedings by regulators such as the Securities and Futures Commission, Accounting and Financial Reporting Council, Hong Kong Stock Exchange, Hong Kong Monetary Authority, Insurance Authority.
  • Advising on coverage (including, life and health, Property All Risks), claims handling issues as well as defending insurance claims commenced in courts.
  • Advising and representing provisional liquidators / liquidators in winding-up proceedings and large scale restructuring of listed companies including cross-border, parallel Schemes of Arrangement.
  • Advising and representing listed companies in opposing winding-up petitions.
  • Advising and representing public bodies / authorities in high-profile judicial review.
  • Acting for the directors of listed companies in defending negligence and / or breach of fiduciary duty claims.
  • Advising secondary schools (including, international schools) and universities in contentious employment matters, disciplinary proceedings, and commercial disputes.
