In Page v Kidd & Spoor Harper Solicitors, Kennedys successfully defended an appeal against a grant of summary judgment on the basis that the claim was statute barred under s14B Limitation Act 1980.
On 15 November 2021, the Civil Justice Council (CJC) published an interim report for consultation on the subject of pre-action protocols (PAPs). Following the conclusion of the consultation on 21 January 2022, the CJC Working Group will draft a final report for consideration by the Civil Justice Council, likely in the Spring of 2022.
Kennedys has responded to the Ministry of Justice’s Call for Evidence on the future of dispute resolution in England and Wales, highlighting that technology has the potential to resolve disputes on a more efficient, humanised, simpler and inclusive basis.

Aggregation of client account thefts: a challenging first instance decision for primary layer insurers
On 28 October 2020, the High Court handed down summary judgment in the related proceedings of Baines v Dixon Coles and Gill and Guide Dogs for the Blind Association v Box. The judgment is important for professional indemnity insurers as to aggregation in cases involving the theft of client monies.
