Case review 20/10/2020
Kennedys marine team won a significant victory recently in the California Court of Appeal in the case of Prickett v Bonnier Corp [13 October 2020] which dealt with the issue of damages for loss of society in the context of a maritime case.
We consider some recent decisions addressing issues including: limitation of liability for marina or dock operators; who is the ‘operator’ of a vessel; parties’ obligations under a chain of letters of indemnity and; interpretation of maritime contracts according to the US Supreme Court.
Kennedys has continued its growth in the United States with the opening of its first West Coast office, in San Francisco, and the addition of a four-partner team.
