Navigating the COVID-19 risk landscape

Sarah-Jane, who joins from Cooley LLP and will be based in Kennedy’s London office, specialises in litigation and regulatory matters relating to product safety, product compliance and product liability.

The customer is always right… or maybe not…
Kennedys recently secured a finding of fundamental dishonesty under Section 57 of the Criminal Justice and Courts Act 2015 in an injury claim brought by a customer visiting a well-known fashion retailer. The claim was struck out and the claimant was ordered to pay the defendant’s costs, to be enforceable against him.

Security for costs – a further blow to commercial funders and their clients
Our previous article considered the High Court’s decision in Rowe & Ors v Ingenious Media Holdings plc & Ors. The Court of Appeal (CoA) has now provided guidance on when a court should exercise its discretion to require a voluntary cross-undertaking in damages as a condition of requiring a claimant or their commercial litigation funder to provide security for costs.

Kennedys continues to grow in 2021, with the acquisition of Langleys’ insurance team. This sees Kennedys opening an office in Leeds, our 12th in the UK and 42nd globally. The new office will be headed up by David Thompson formerly Managing Partner and Head of Insurance at Langleys.
