Allocation between covered and uncovered claims, and advising the insured of its allocation burden
As a majority rule, the burden is on the insured to allocate between covered and uncovered claims. For example, when a judgment against an insured includes damages for which an insurer is liable and also damages beyond the coverage of the policy, the insured has the burden to establish (i.e. to allocate) which percentages of the verdict represent covered damages versus uncovered damages.

Directors & officers and their insurers await detail of UK audit reforms
The government is set to publish a white paper with proposals for the reform of UK corporate governance and audit oversight. Accountancy firms are already splitting out their audit and consultancy arms and a new regulator, the Audit Reporting and Governance Authority, will replace the Financial Reporting Council.

Singapore introduces mandatory data breach notification requirements
At the beginning of February, Singapore became the latest Asian jurisdiction to introduce mandatory data breach notification rules. The new rules were enacted as amendments to Singapore’s Personal Data Protection Act 2012 (“PDPA”), which has been in effect for more than six years.

CYBER: New privacy bill sent to Virginia governor for signature into law
On Friday, February 26, 2021, SB 1392, the Consumer Data Protection Act (CDPA), was communicated to the Virginia Governor’s Office after the Virginia Senate passed a Virginia House substitute bill (for HB 2307) 32-7. Governor Northam is expected to sign the bill, which would establish a framework for processing personal data in Virginia.
