- Handled a latent defect portfolio with more than 200 files for a London Market insurer. Most of the claims were fully dismissed and the claimants ordered to pay legal costs.
- Defended architect for construction damages in a pre-existing building. This was a complex claim with very high quantum, which was fully dismissed with legal costs.
- Defended technical architect in criminal and civil proceedings for fatal casualties arising from building works.
Javier is an Associate in Kennedys’ Madrid office. He qualified in Spain in 2004 and is fluent in English and French.
Javier specialises in professional indemnity and handles matters protecting insurers’ interests and defending their insureds in civil and criminal courts. He is also skilled in construction claims and dispute resolution, civil, professional contractual and extra contractual liability, and damage claims.
He routinely represents architects, surveyors and health and safety coordinators in claims relating to workplace accidents, lack of security measures or any other claim against them in the performance of their professional duties.
Javier also manages the bordereaux for London Market insurers and international insurance companies that write professional indemnity policies in Spain for diverse professions. He manages their claims from receipt of the claim through to the final judgment, should the matter result in court proceedings.
He is an active member of the Spanish Association of Young Insurance Professionals, giving him access to the professional indemnity committee of the Madrid Bar Association. He is also involved in planning and writing the firm’s publications.
