Andrew Swarbrick

Andrew is a senior associate in Kennedys’ London office. He joined Kennedys in 2018 having qualified in England and Wales in September 2016.

He specialises in advising and representing clients in health and safety investigations and prosecutions, including manslaughter, and in advising and representing clients at inquests. Andrew also has wide experience of advising clients in respect of investigations and prosecutions brought by other regulatory bodies such as the Environment Agency and Trading Standards authorities.

Andrew has experience of a wide range of industry sectors including construction, waste and recycling, automotive, manufacturing and food and retail. He regularly represents large, multi-national corporate clients. He also regularly provides advice to clients in respect of regulatory compliance issues and in particular specialises in guiding clients in respect of fire safety reform, including in particular the Building Safety Bill.

Andrew also has experience of advising and representing clients in respect of judicial review proceedings.

Andrew is a member of the Health and Safety Lawyers’ Association and the Form of Insurance Lawyers (FOIL). He also regularly presents at Kennedys’ seminars, delivers external lectures and writes articles on recent legal developments.

  • Successfully defended the managing director of a wood recycling company on charges of gross negligence manslaughter following an explosion at the company’s recycling facility.
  • Provided tailored advice to the UK’s largest private student accommodation company in respect of the Building Safety Bill introduced to Parliament in the summer of 2020
  • Provided advice to leading global stationery retailer in respect of a trading standards prosecution including securing a discontinuation of proceedings
  • Successfully defended the managing director of large national high-street retail company prosecuted under section 37 of the Health and Safety at Work Etc. Act 1974
