Andrew is a Partner in Kennedys’ London office. He specialises in product liability (non-pharma) defence, insurance coverage and property (first party and liability) and contractors’ all risks.
He is also experienced in representing manufacturers and their insurers in various product liability claims. These include claims arising from medical devices, contamination in food manufacturing and processing, fuel contamination and recovery claims arising from them.

He has been instructed on a number of complex and high value matters, often with an international element, including determination of applicable law in respect of product liability claims brought in England for products distributed overseas.

He has extensive experience in insurance-related advice, in particular litigation and dispute resolution, policy interpretation and disputes, fraudulent claims, recovery claims and commercial disputes.

Andrew advises on construction and property-related claims involving fire, flood, environmental contamination, subsidence and associated building and design failures, and business interruption.

Andrew has lectured at many forums, including the Chartered Insurance Institute, the Chartered Institute of Loss Adjusters and Queen Mary College, University of London. He is a member of the Forum of Insurance Lawyers (FOIL) and the Chartered Institute of Insurers, and is ACII accredited.

  • Acted for project insurers recovering over £17 million from statutory undertaker, representing 98% of policy outlays in respect of remedial costs and loss of rental income following water main burst. Secured substantial early interim payments on account of damages but pursued contested heads of loss to pre-trial settlement.
  • Acting for manufacturer in multiple claims alleging product defect in a recalled medical device, including liability aspects of design, state of the art and causation, creating without prejudice forum for resolution of claims, successfully opposing group litigation order application and securing a stay of actively litigated claims.
  • Coordinating the defence and resolutions of the above-mentioned product claims throughout EMEA jurisdictions with local lawyers. Established a landmark court-approved alternative dispute resolution process in Ireland.
  • Advising liability insurers of building contractor facing a subrogated claim of over £7 million for water damage to high-end domestic property, considering causation, potential liability of insured and potential for recovery from subcontractor in liquidation.   
  • Doheny and others v The New India Assurance Company Ltd and another [2004]. Representing defendant insurer in Court of Appeal case regarding proposal form wording and reference to full disclosure and bankruptcy.
  • Allen and others v DePuy International Ltd [2014]. Determination of applicable law and the application of Consumer Protection Act for products manufactured in England and distributed outside UK.
