Nigel Chan qualified in Hong Kong in 2017. His commercial litigation practice covers insurance related disputes, shareholders’ and directors’ disputes, winding-up and bankruptcy proceedings, trust disputes, professional negligence claims, internet fraud, and contentious employment matters.  Nigel is also experienced in handling regulatory defence matters including investigations by the Securities and Futures Commission and white collar crimes involving the Independent Commission Against Corruption.  Nigel is one of the contributors of the Securities & Futures Ordinance (Cap. 571) – Commentary and Annotations – 2019 versions, published by Sweet & Maxwell.  Nigel is fluent in English, Cantonese and Putonghua.

Work highlights

  • Advising and representing a licensed corporation and its employees in a SFC investigation in relation to internal control deficiencies and money laundering issues. The Commission ultimately decided not to proceed with the proposed disciplinary action against the licensed corporation.
  • Advising and acting for an accountancy firm in a High Court Action commenced by liquidators involving professional negligence claims in the sum of over HK$720 million.
  • Acting for a foreign plaintiff company in obtaining an injunction and subsequent proceedings involving fraudulent transactions of over US$10 million.
  • Representing a director of a company listed on the Main Board in defending various related and high profile High Court Actions involving allegations of fraud and breach of fiduciary duties.
  • Advising and representing life insurance companies in defending claims commenced by its former agents involving allegations of misrepresentations, wrongful termination and breach of implied terms of contracts.
