In the wake of the Optus and Medibank data breaches, each of those businesses faces a representative complaint and at least one class action. Until now, complaints and litigation arising from data breaches have been fairly rare in Australia. Will these actions mark a turning point in the frequency of data breach disputes in Australia?
This webinar will look at the various bases on which plaintiffs and complainants can bring actions in relation to a data breach under Australian law – through the OAIC complaints process, the tort of negligence, breach of contract, Australian Consumer Law, and shareholder actions – and the issues that arise with each. It will also look at the statutory tort of serious invasion of privacy and the proposed direct right of action under the Privacy Act.
