Perfluoroalkyl and Polyfluoroalkyl substances (PFAS), often referred to as 'forever chemicals' are a complex and expanding group of man-made chemicals found in a variety of products used by consumers and industry. The chemicals have recently been under the scrutiny of various stakeholders across the globe, culminating in extensive litigation in the US, Belgium and other jurisdictions because of their alleged impact on health. Significant partial settlements in the US by DuPont / Chemours (USD1.185 billion) and 3M (USD 10.3 billion) in respect of claims for polluted water supplies were announced recently and suggest that insurers will be targeted in the coming months.
We are delighted to be hosting a roundtable discussion on Wednesday 20 September at our London office, where we will cover the practical considerations for Bermuda Form insurers, including commentary on the key coverage considerations arising from PFAS related claims.
