Legal Professional Privilege in Cyber Incident Forensic Reports

We are delighted to be hosting our seminar on “Legal Professional Privilege in Cyber Incident Forensic Reports” to be held in our Melbourne office on Thursday 21 March 2024.

The recent decision of Justice Beach in Robertson v Singtel Optus Pty Ltd [2023] FCA 1392 rejected a claim of legal professional privilege over a forensic investigation report prepared by Deloitte into Optus’s September 2022 data breach.

This seminar looks at the case and its implications for Australian entities responding to a cyber incident. The decision provides lessons about the challenges of establishing legal professional privilege in a forensic investigation report, what conduct is inconsistent with legal professional privilege, and the importance of getting lawyers involved in the cyber incident response process early.
