Andrew McFadden joined Kennedys’ Dublin office as an associate in February 2023. He transferred to the Dubai office in January 2024.
Andrew specialises in aviation litigation, and he has significant experience in a range of aviation-related disputes, including disputes under the Chicago Convention, Montréal Convention, and complex coverage issues arising out of the Russian invasion of Ukraine.
Andrew also acts in construction-related professional indemnity claims, representing a range of construction professionals such as contractors, architects and other design team members, as well as subrogation claims on behalf of insurers and coverage disputes. He is also regularly instructed in shipping and marine claims, including those under CMR and various other national and international laws and conventions.
In Ireland, Andrew has represented and advocated on behalf of clients in the District Court, Circuit Court, High Court, Residential Tenancies Board and the Workplace Relations Commission, as well as in mediation and arbitration. In the UAE, he has experience of disputes in both the onshore and offshore (DIFC and ADGM) Courts as well as various forms of alternative dispute resolution.
Andrew is admitted to the Roll of Solicitors in both Northern Ireland and the Republic of Ireland, as well as being registered as a Legal Consultant with the Government of Dubai Legal Affairs Department. He is a member of a number of different industry groups, including the Construction Bar Association of Ireland and the Irish Business Network in Dubai.

- Acting on behalf of the War Risks insurers of commercial aircraft lessors in six separate but concurrent Commercial Court proceedings, arising out of the Russian war in Ukraine.
- Defending the architect of a major Dublin apartment complex, being pursued as part of a subrogated recovery claim for damage resulting from water ingress.
- Acting in a high value coverage dispute arising out of VAT carousel fraud, involving the subsidiary of a major Irish company based in mainland Europe.
- Defending a major Irish Port in respect of a significant workplace personal injuries claim.
- Pursuing a major global technology brand as part of defamation and data protection proceedings arising out of the Russian invasion of Ukraine.
- Acting on behalf of an international shipping provider in relation to damage resulting from a “grounding” incident of a cargo ship at an Irish Port.
