Kennedys partner Jay Hamad and associate Dean Aronin recently obtained a defense verdict at a jury trial in a New York Supreme Court case involving New York’s strict liability Labor Law § 241(6).
Jay and Dean defended a large property developer, who was the owner and general contractor for the project against claims alleging multiple violations of the New York State Industrial Code. They were able to overcome Plaintiff’s motion for summary judgment and motion for directed verdict on the issues involving strict liability under New York Labor Law § 241(6).
After less than an hour of deliberations, the jury returned a unanimous defense verdict finding that there were violations under the Code but that the Plaintiff failed to prove proximate cause and placed 0% liability on their client.
