MoJ: Implementation date for whiplash reform programme set
New rules that provide the framework underpinning the whiplash reforms and use of the new online portal have been published. Responding to publication of secondary legislation to introduce the whiplash reforms on 31 May, Ian Davies, who leads our motor team, says:
"Make no mistake – these are seismic changes to low-value RTA claims in England and Wales. The market is now set for a frantic three months of development to ensure systems are in place to deal with the claims from 31 May under the new regime.
But the true scale of the challenge in preparing for 31 May will only become clear once we have absorbed the new practice direction, pre-action protocol and the detail around the new portal. There are bound to be grey areas and points of friction which will ultimately require resolution by the courts.
Every release of information brings greater clarity."
Due to this latest announcement, we are delighted to be hosting our Motor Webinar Special webinar on Friday 5 March 2021, focusing on the whiplash reforms update where our panel of experts will consider the implications of these new rules and discuss the potential impact on the motor industry.
